Not only that 4apay's photo doesn't deserve the second place (there are so much better works, and even the third photo is far superior), but it's also a stolen idea.
Nice to see that deviantart supports plagiarism.
So...a person with mediocre work which couldn't think of something original won the second place? *clap, clap*. Well done deviantart.

Yes, the photo is exactly the same (although better photoshoped), but durrr it's not stolen. It's a coincidence.
Just like the famous ''coincidences'' between Easter and old pagan rituals.

Anyone can have an idea. And if you want my opinion, the idea is so common that I have little doubt the only thing that happened is just that two people came up with it. The manips are totally different, but the Liberty Statue image is the same because it was probably the only one avaliable by the Fotolia stock. :B

I'm sorry I'm giving my opinion on someone else's conversation (and I don't mean to offend you either), but I have seen a lot of your comments all over the place. I do get your point. It's not impossible that it's a coincidence, but it's very improbable. you see, even if they had the same idea, it's the same fruit, the same cat, and the clock is at the same place. There is no proof that he stole it, but don't you think the chances that he didn't are slim?

This is simple to answer: as this was a Fotolia contest, they offered a stock for the artists to use. And in the stock the options were limited, so it's not surprising they used the same elements. Most of the stock pictures offered wuld not fit this idea anyway. I have seen the same stock being used in other pictures for this contest all over the place, just applied in different situations. Most of pictures used strawberries though... but any decent photomanip artist would see a strawberry would not fit the picture. A long fruit like a pineapple seems the most obvious option, and I can see on their stock account [link] is the only one that could be used in that context:shrug: And the contest had to use 'one cat, one fruit and one clock'.
I am not defending people, I am just saying that people who are making acusations seem to be unable to see the situation in the big picture. I have dealt with art thievery and such several times before, so I am not just giving an opinion randomly. I may not be the best person to talk about that, but I certainly have a bit of experience.
And one detail: They did not use the same clock.:B

yeah, you do have a point. I never participated at a contest before, so I didn't know there was a stock. that's why I thought it was weird that they used the same cat and the same fruit. I guess there is no telling if he stole the idea or not. If he did, he cheated, and there isn't anything we can do now. If he didn't, then I hope he enjoys his prises...

Yeah. But I think that, considering the deviation was nor removed or anything, dA most likely came to the conclusion that it was just a coincidence.:XD: in a contest this big, it would not be such a big surprise two people had the Statue of Liberty idea.

The second Winner is someone who should have not won.

He/she should be ashamed. Not only did he/she steal the idea of -- [link] , but he/she violated the terms and conditions of the Terms and Agreements of the stock he/she used, found here -- [link]

The terms clearly state you cannot (and I bolded his/her violations):

"post the Work online in downloadable format, post the Work on an electronic bulletin board, or enable the Work to be distributed via mobile telephone devices. Include the Work in any electronic template or application, including those that are web based, where the purpose is to create multiple impressions of an electronic or printed product, including but not limited to website design, presentation templates, electronic greeting cards, business cards or any other electronic or printed matter"
and
"Use the Work in an editorial manner, without the following credit adjacent to the Image: " [Photographer's name] / [Name of the agency providing the Image].; "

Da automaticaly allows a picture to be downloaded, his/her first violation.
His/her second, Da also enables "the Work to be distributed via mobile telephone devices".
his/her third, you cannot "Include the Work in any electronic template or application, including those that are web based", that includes contest entries, since entries are a form of application.

his/her fourth violation, he/she did not put the Photographer's name / Name of the agency providing the Image on the side of the image as was required. This violation MAY be excluded because he/she did link in the artists comments; however, his/her previous 3 violations stand.

That artist used some of the the same stock photos as the other person did, and the same idea. Which I believe, IS plagarism.

you could also say that Apple could have stolen Microsoft's OS Idea or the other way around.

But it's more than the same general idea. I repeat, the same stock photos arranged in the same way looks like plagarism to me. I seriously don't get how you think it's okay. I'm not being picky, I just think it's common sense that one of those pictures was copied off of the other. And since the other artist posted first, so the winning one obviously took the idea from the first. I highly doubt this was some coiencidence. And obviously, the winning artisit did not have the creative capacity to come up with their own idea. If anyone makes you sad, it should be an artist that copied off of the ideas of others, not people who think that plagarism is wrong.

no it's that that one comments on a picture, that it's stolen and hundrets of others copy what that person said like goddamn parrots!

And I don't think that plagiarism is okay

I only think, it's plagiarism, when that person is just copy-pasting that image into their own gallery and then saying: "i mead that pictchur, and i came up with that idea all by myself, derp"

Yes I hate Plagiarism, that's why I'm using Watermarks frequently, but I'm not permanently ranting about it!

You don't have to copy an entire thing to make it plagiarism. Simply doing a key point makes it so. Example being, copying a single paragraph from an already published essay for a school project. You are not copying the whole but it clearly isn't yours and it was something copyrighted by someone else. If you do that in most public schools, it is grounds for suspension, some academies even expel the person doing it.

The fact that people are calling it a theft even though it is a stock image from someone here on DA, is because they didn't credit the group or person that provided the stock. You are required to do so here on DA if you use stock from someone else, AND they violated the Terms and Conditions of the stock photo, found here --> [link]

The same deal with always adding a copyright to Fanart

but the thing that bugs me the most are not the stolen images on dA itself but more the stupid "OMG that's stolen!!!" messages. Just report the stolen works and don't comment on them, because they're getting more views than they deserve that way

So you really believe that that artist made that picture completely by his/herself, without taking ideas from the first? Because... I dunno they look very similar. And even if they did take the idea, since they aren't exactly the same, it's perfectly okay for the artist to use that image? Without asking or creditting the other artsit? Really... that's what you think?
