I see that there have been two winners announced, including one that used an outside, copyright protected theme (The Good, The Bad, and the Ugly). Is this legit?

Seems like a little bending of the rules is cool and groovy? Though, not to the artists that came up with their own theme and such.

From the Official Contest Rules:
  • The Work:
    • must be approximately 2,000 pixels in width and 550 pixels in height;
    • must be the Entrant's original work made for the Contest and may not use stock materials from others, trademarks, or characters other than those from the Despicable Me films;
    • licensed brushes and textures are acceptable as well as original assets from the Entrant's own work, and visual elements from Despicable MeDo not include the "Despicable Me" name in your entry;

Hi =miketheartist

I wanted to take a minute to address your concerns. The entry you are inquiring about does depict actual characters from "Despicable Me" pretending to be from a western with specific reference to the concept of “The Good, The Bad and The Ugly.”  The reference to that film is as cultural material used in common conversation.  It is not the placement of the characters from the film into the entry and the entry doesn’t “copy” the people from the films.  It does use some similar elements, but altered in a way that the Despicable Me minions would have done if they were play acting a western.  As such we did not interpret the entry as containing any actual trademarks, characters or copyrighted content belonging to a third party.  We do, however, appreciate your question and understand your concern.

All the best,

Danie

I'm sorry, but I wholeheartedly disagree. That piece is clearly based on the movie. Oh well. Guess I won't be entering any more contests on deviantArt, and once my current membership runs out, I won't be paying for another.

I totally concur.  It's a blatant spoof of he GBU movie using Minion characters.  With that said, it is an awesome job of it and much credit due the creator, however it is a clear violation of the rules.   But that is DA and how they've always operated, with extreme bias and prejudice, which is why I would never bother with any of their contests.

Additionally, I don't see any mention of Universal Studios and their intellectual property, or a release and permission thereto.  Meanwhile DA is encouraging the manipulation, copying and usage of Universal characters without giving the participants any legal release or permission from Universal, while DA reaps the benefits and rewards of increased exposure and financial gains from the promotion.
